Divorce mistakes California residents should avoid

Making a mistake during a divorce can be costly from a financial and human standpoint. Individuals who choose the wrong form of divorce or are too confrontational during settlement talks could put a strain on relationships with their children and former spouse. Furthermore, they could spend thousands of dollars in legal payments that they didn't need to spend to get the resolution that they wanted.

In any divorce proceeding, it's important to focus on the bigger picture. While winning extra child support or getting an extra piece of property may feel satisfying in the short-term, it could have negative consequences in the long-term. For instance, those who receive property or cash in a divorce may often incur a tax burden which could reduce the value of any assets received.

Posting on social media is something that should be avoided if at all possible. Anything that is posted online can be used as part of a divorce proceeding, and it could cost an individual child custody rights or lower the amount of alimony received. It may also further strain a relationship with a child or mutual friends.

Those who are going through a divorce may wish to talk to an attorney prior to agreeing to any settlement. Legal counsel may help an individual with property division issues as well as child custody matters. If a couple has a prenuptial agreement, an attorney might be able to determine its validity. In the event that the agreement is valid, it may guide the couple or a judge as to how to split property once the divorce is finalized.
