Are Spousal Support Agreements Permanent? 

Over time, your situation may change, as may your ex-spouse’s. You may be able to modify your spousal support agreement, depending on the circumstances. Doing this can be difficult, as California family law courts prefer to have financial arrangements set and maintained. Requirements For Spousal Support Modifications

To alter your spousal support orders, you must be able to show a significant change in circumstance. This can include:

  • Losing your job
  • A significant decrease in your income
  • Your former spouse gaining a job or getting an increase in income
  • Your former spouse getting remarried

Either party can request a modification of spousal support orders. If you are paying spousal support and your former spouse’s financial circumstances suddenly improve, you may want to request a lower payment or to stop payments altogether.

If you are receiving spousal support, you may want to request your former spouse pay more if you have recently lost your job or he or she has recently gotten a better job or a raise. For those who have alimony for a specific period, you can request an extension if you need more time to transition back to the workforce in a job that actually supports you and your children.

If you and your former spouse have a good relationship, we may be able to reach an agreement between the two of you and file a modification of court orders with little or no conflict.
