Finding The Right Balance

Family law issues are challenging. Emotions will be stirred, and past problems will be brought to light. Our job is to make this process as stress-free and simple as possible while ensuring you are treated fairly. We are supportive and compassionate about your situation because we know what you’re going through.

Our attorneys will always be honest with you about the law and how it will affect you. They will explain all of your options and their potential consequences so you can make the right decisions for yourself and your family.

We prefer to work with your spouse or co-parent and his or her lawyer to come to a reasonable settlement. If this is not possible, we have significant trial experience and knowledge of California law, which we will use to argue your case before a judge.

California Family Law – Frequently Asked Questions

Family law matters can vary greatly depending on the specifics of your unique situation. It is wise to seek the counsel of an experienced family law attorney to discuss your case and your goals.

At The Koblin Family Law Center, we represent clients in Pleasanton and other East Bay communities who are seeking divorce or other family law matters. While every situation is different, there are certain questions that our clients commonly ask. We encourage you to read our family law FAQ and schedule a consultation to discuss your matter in greater detail.

What is the difference between legal separation and divorce?

Divorce is the dissolution — or ending — of a marriage. One household becomes two and the divorcing couple is not married in the eyes of the law. Based on personal reasons — which could be religious, medical or financial — some couples do not wish to live as a married couple, but also do not wish to legally divorce. A separation, then, is an option for them. Issues such as child support, spousal support and child custody must be addressed through the process. If the spouses choose to dissolve their marriage later, they can do that.

What is an annulment?

Couples choose to annul a marriage — file a nullity — when they want the marriage to be voided or erased from legal records. Under only specific circumstances will the judge grant a nullity. Discuss your situation with an experienced lawyer to determine your eligibility.

Can elements of my divorce order be changed?

The court understands that a divorce order might need to be altered based on changing circumstances. Financial changes such as job loss, reduction in hours or medical emergency can mean that a person is no longer able to meet financial obligations. When this happens, it is crucial that you work through the legal process rather than discussing changes with your ex. A proper modification is documented, legally binding and enforceable. Verbal agreements have none of these protections.

How long is the divorce process?

In California, the process takes a minimum of six months. Disputes regarding support or custody can dramatically affect the length of time.

How is child support determined?

Child support is determined based on the results of the child support guidelines. This calculation is largely based on income and how much time each parent will be spending with the children. Other factors such as child care costs, educational costs and medical expenses can go into the overall determination.

These types of questions are only the beginning. The divorce process can be complex and often frustrating. Having a skilled attorney on your side can mean the difference between a confusing experience and a divorce that runs smoothly and efficiently.
